Repair terms and conditions: 90-day warranty from the invoice date. June Company, Inc. reserves the right to refuse any warranty due to negligence or misuse of the product. ** Unauthorized in-field repair or tampering with repaired items will result in the warranty being voided immediately. June Company, Inc. repair/calibration sticker must be intact. The warranty will not apply to items that fail due to misapplication, including but not limited to, improper operation, storage, or installation; negligence, abnormal temperature, moisture, dirt or corrosive conditions, or due to an act of nature. June Company, Inc. strongly recommends sending all parts and components for testing as a complete unit. June Company, Inc. is not and cannot be responsible for incoming repair with missing parts and can only assume the customer’s product is complete and therefore is serviced accordingly. June Company, Inc. cannot offer warranty repair if June Company, Inc. repairs a product that is repaired and damaged due to customer system failure.
Remanufactured Sales terms and conditions: All obsolete products, units, systems purchases by customers are final unless the unit is defective. If in case the product is defective, the customer may send the product back to June Company, Inc. for repair only if approved with an RMA number provided by June Company, Inc.
Research and Administrative/Handling fees: June Company, Inc. reserves the right to charge an administrative/handling fee of $145.00 per item for quotes declined by the customer. Payments for administrative handling fee invoices are due within 15 days from the invoice date, or the unit will be deemed abandoned and scrapped. Payments for non-repair can be prepaid with a U.S. dollar check or ACH transfer within 10 days to avoid being declared abandoned and scrapped.
Payment Terms: June Company, Inc. accepts MC, Visa, electronic checks, money orders, and prepaid U.S. dollar checks. A finance charge of 3% per month will be charged on the unpaid balance of past due accounts. Payments are due in full before the unit is returned.
Shipping terms and conditions: Industrial Division: June Company, Inc. is not responsible in any way for shipping damage or misplaced packages and highly recommends shipping insurance. A prepaid and preprinted return shipping label is to be included in the box with the unit being shipped for repair or calibration. June Company, Inc. cannot prepare or generate return shipping labels or customs documents that may be required for return shipping.
Remainder of Terms: All sales and services are presumed to have taken place in the state of Oregon and those above described warranties provided by June Company, Inc. shall be construed under the state of Oregon law, without regard to conflict of law provisions. Venue for any dispute arising hereunder shall be in that State or Federal Court nearest to the main office of June Company, Inc. The parties hereby agree to personal jurisdiction over them in such courts. June Company, Inc. shall be entitled to attorney’s fees and costs including pre-and post-judgment should it have to enforce its right under this transaction. Customer warrants that it is and shall remain in full compliance with any applicable United States, State, and/or local regulations controlling the sale and delivery of good for export and is and shall remain solely responsible therefor. The terms set for herein constitute the entire agreement regarding this transaction, except for product and or service description and pricing, and subject only to June Company, Inc. credit agreement (if any) with you, our invoice, and our separate order confirmation (if any). In the event any part of these is deemed unenforceable by a court having jurisdiction thereover, such unenforceable term(s) shall be modified to make them as enforceable as possible, and the rest of these terms shall not be affected. Ant contrary terms offered by the customer are not a part of this transaction. Customer shall defend, indemnify and hold June Company, Inc. and its agents harmless from any breach by it of these terms or any misuse or abuse by it of any item sold and/or serviced hereby. The goods sold hereunder shall be at the risk of the customer upon delivery by June Company, Inc. to the carrier F.O.B. shipping point. Title to the goods sold hereunder shall remain in Seller possession until payment in full by Buyer. June Company, Inc. shall not be responsible for delays caused by manufacturing plants, transportation, strikes, fires, floods, storms, war, insurrections, riot, any government regulation, order, act or instruction, or any other circumstances beyond its control, and Customer hereby waives any claims relating to same.
